Shopped hard, finally, the rebates convinced us

The Bottom Line: Time will tell, but the machine is currently living up to our expectations. Cheaper machines exist though.
I was very very anxious about picking this wash machine due to the class action lawsuit. I looked at a number of models and asked a lot of questions. With the class action law suit as my guide I grilled a number of sales people at a 3 different stores, and was satisfied enough to take a gamble. Actually the total $200 of rebates are the thing that weighed the scales. We've had it only 2 weeks so that MUST be remembered but so far, so good. The design changes promised have been incorporated into this generation of the Neptune.
I WILL write back on this page if we start to be anything be pleased.
Some notes:
I'm opening the door soon after every load to avoid smell, etc. Also it's recommended to wash the rubber gasket with a bleach soln. every few months. And to run a bleach cycle. Not sure if I will run a load with just bleach as we use it in some clothes cycles. Wash cycle takes 48 min. for 'soiled.' Haven't noticed any standing water in the tub that won't drain. There is a sloshing as the tub is turned, but that is normal as the tub surrounded by a soln. to help with balance during spin. Smaller loads tend to put the machine into a slight imbalance which slows final spin speed.
