sold me an open box as new!

Not Happy, this store sold me an open box as new, Costumer service just insists that it is a new unit but the cord was not wrapped up correctly and the box had been ripped open tearing it. I sent them pictures but they still deny it! If this is not an open box item I do not know what is! And after they state in they return policy that they can not sell and open box as new! Bad people!

They say in there return policy

"(For Opened Units)
You may return opened units for a refund within 30 days of receipt. Since
this product return is not due to our error, a 15% restocking fee plus the
to and from shipping and handling costs will be assessed. Since these
units are opened, they cannot be sold as new. Opened units include items
damaged in shipping and defective items where we are not allowed an
opportunity to correct the error. Any shipping and handling costs are not
reimbursed. We will issue a call tag to have a shipper pick up the unit. The
standard cost for shipping is $15 to $35 for shipping the order back to us."
